Assumption of Risk, Release of Liability, Waiver of Claims, and Indemnity Agreement

By signing this document, you acknowledge that you are waiving certain legal rights, including the right to sue. Please read this waiver carefully.

This agreement applies to Neev’s Giggle Garden, including its owners, agents, officers, affiliates, volunteers, participants, employees, and any other persons or entities acting on its behalf.

By signing this waiver, I voluntarily give up my rights, as well as the rights of my spouse, children, and/or wards, to sue Neev’s Giggle Garden for any injury, including paralysis or death, arising in whole or in part from the negligence or fault of Neev’s Giggle Garden.

I further grant Neev’s Giggle Garden the unrestricted right to photograph, video record, and/or monitor me and/or my child(ren)/ward(s) via closed-circuit television or other recording methods without compensation.

I represent that I am the parent or legal guardian of the participant(s) named below, or that I have obtained authorization from the parent or legal guardian to sign this agreement on their behalf.

I understand and acknowledge that participation at Neev’s Giggle Garden involves both known and unforeseen risks that may result in physical or emotional injury, paralysis, death, or damage to myself, my child(ren)/ward(s), property, or third parties.

I knowingly and voluntarily assume all such risks, including those that may arise due to the actions of other participants.

I agree that I and the participant(s) named will comply with all posted rules, safety signage, and verbal instructions as conditions for participating in any play activities, events, or parties at Neev’s Giggle Garden.

I, on behalf of myself, the participant(s) named, our heirs, assigns, representatives, and next of kin, agree to release, waive, discharge, and hold harmless Neev’s Giggle Garden, its owners, members, affiliates, officers, employees, equipment manufacturers, and sponsoring agencies from any and all liability to the fullest extent permitted by law.

I further agree to indemnify and hold harmless the above parties from any costs, expenses, or claims arising from participation in any activities at Neev’s Giggle Garden.

I confirm that I and the participant(s) named are physically able to participate and that I am legally competent to understand and sign this agreement. I sign this agreement freely and without coercion.

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

I agree that any dispute arising from this agreement shall be resolved by binding arbitration under the Arbitration Act (Ontario), conducted by a single arbitrator, within the Province of Ontario, and governed by the laws of Ontario. Any such claim must be brought within one (1) year of the date of this agreement.

I acknowledge that I have read, viewed, or been informed of the rules governing participation at Neev’s Giggle Garden. I confirm that I understand these rules and have explained them to my child/ward. I understand that these rules exist for the safety of all participants and that failure to comply may result in removal from Neev’s Giggle Garden without refund.
